Introduction
Kirrk, located at 36 rue Friant 75014 Paris, France, is a technology provider for mobility that designs and publishes the Kirrk platform, which is accessible via the Internet (at https://www.kirrk.com/) as well as via a mobile application, Kirrk, and which allows in particular to display bookings made within Kirrk's partner rental companies and to interact with the rented vehicle via the mobile application. Kirrk is not a rental agency or travel operator.
The use of Kirrk, including the creation of an account, the use of the application and interactions with the vehicle, implies prior acceptance of these Kirrk general terms and conditions of use.
Kirrk's "Client" (you) is a natural person acting as a consumer.
The majority of Kirrk's services, namely those appearing in the application, are only available to registered Customers, i.e. those with a Kirrk Account and a confirmed vehicle rental.
A. Purpose of these general terms and conditions of use
The purpose of these general terms and conditions of use is to govern the use of Kirrk by the Client (via the Internet or mobile application) and the creation and use of his Kirrk Account by the Client.
These general terms and conditions of use do not govern the relationship between the Client and partner rental agencies, including vehicle reservation services and their use with partner rental agencies, are subject to separate general terms and conditions to be accepted by the Client at the time of booking such services, if any.
B. Booking with our partner rental agencies
B.1 Booking
You can book a vehicle directly via the website of our partner rental agencies.
You must receive the reservation confirmation of your vehicle and receive a first email from Kirrk inviting you to create your account to be eligible for Kirrk service. Payment and confirmation of the reservation is made directly on the platforms of our partner rental agencies.
The Kirrk website and mobile application do not yet offer the possibility to book a vehicle.
B.2 Payment
The payment of the reservation by the Client is made directly between the Client and the chosen partner rental agency.
After validation of the reservation with the agency and registration on Kirrk, the Customer can finalize the payment of his reservation directly on the Kirrk application if it has not been prepaid.
B.3 Modification or Cancellation
Any modification or cancellation of the reservation is made directly with our partner rental agencies.
If you have cancelled a rental that is eligible for a partial or total refund, and the payment has been finalized since the Kirrk application, the amount that will be communicated to us by the partner rental agency will be refunded after validation of your eligibility by the partner rental agency within thirty (30) days.
C. Reservation on the website www.kirrk.com
C.1 Reservation on the website www.kirrk.com
At the time of your reservation, you will be offered different categories of vehicles, depending on availability for the period concerned, the place of departure and the place of return. Kirrk is not able to guarantee the rental of a specific vehicle but will provide you with a model at least equivalent (comfort, power, etc.) to the one for which you have made a reservation.
In order to benefit from the services via the www.kirrk.com website, you must create a Kirrk account and comply with the necessary conditions set out in section (D) "Kirrk Account Creation".
C.2 Terms and conditions of sale on the www.kirrk.com website.
Kirrk being in partnership with our partners, our general terms of sales are aligned with their general terms of sales.
Although we make every effort to ensure that the prices displayed on our Kirrk.com site are accurate, errors may occur. We will inform you as soon as possible if we become aware that the fare for your booking is incorrect and allow you to confirm it at the current rate or cancel it without charge. If we are unable to contact you, your reservation will be considered cancelled.
C.3 Payment on www.kirrk.com
The payment of the reservation by the Client is made directly in prepayment on the website www.kirrk.com, i.e. at the time of confirmation of the reservation.
This prepayment covers the amount of your rental (depending on the number of days desired), optional services and insurance, excluding any additional costs that may arise during the rental period.
C4. Method of payment
The credit card you registered at the time of booking and linked to your Kirrk account will be debited for the amount indicated. You will then receive a booking confirmation email and a receipt for the associated payment. In addition, the prepaid amount will be mentioned on the final invoice and deducted from the total amount still to be paid.
The credit card used to make the reservation must be in the name and surname of the account holder, which must match the information on the driving licence. We do not accept prepaid cards (such as Visa Electron or Mastercard Maestro).
Credit card registration and payment transactions are directly managed and secured by the Stripe payment provider.
At the time of booking confirmation, and for reasons of payment security, we have implemented the 3D Secure system. Thus, provided that your bank is equipped with the 3D Secure protocol, at the time of payment, you will be redirected to a site of your bank where you will be asked to authenticate yourself using personal data previously defined with your bank (the authentication methods are specific to each bank). After validation of this entry and agreement of your bank, the payment will be validated and your reservation confirmed. This authentication is mandatory to confirm your reservation. In the absence of authentication or in case of failure, your reservation will not be confirmed.
C5. Means of payment and guarantees
At the time of each reservation, you authorize Kirrk to check the validity of the credit card linked to your account and to debit the amount of each rental as well as the selected options and any additional charges.
You acknowledge that you have been informed and accept that the credit card used may be debited for the purchase of options during the trip and in the event of any charges incurred during the rental or at the end of the rental period. Kirrk will only debit the amount in question in the event of the purchase of options, damage to the vehicle and/or extras noted at the end of the rental period.
You are informed and accept that, for technical reasons, in particular those relating to the duration of your reservation, Kirrk may need to check your payment method again.
C.6 Young Driver Surcharge
For any Client under twenty-five (25) years of age, a mandatory supplement of 40.84€ per day of rental (maximum at 490.03€ for a rental) will be automatically applied. If this supplement is not paid, the corresponding reservation may be cancelled.
C.7 Modification of your reservation
To change the dates of your booking, you must contact the rental agency through which you reserved your vehicle.
If the booking dates are changed, we will recalculate the price of your rental based on the conditions in effect at the time of the change. In addition, a change fee will apply according to the following terms and conditions:
- Before the departure date of the rental: 15€.
- After the departure date of the rental: No modification possible.
To rent a higher vehicle category, you must contact the rental agency through which you reserved your vehicle.
C.8 Cancellation of your reservation
To cancel your booking, you must contact the rental agency through which you reserved your vehicle.
In the event of cancellation, we will refund your rental within 15 days, less a cancellation fee, based on the following conditions:
- Before the departure date of the rental: 45€ cancellation fee.
- After the rental departure date and within 90 days after this date: 95€ cancellation fee.
- More than 90 days after the rental departure date: No cancellation possible.
It is not possible to cancel options that have already been paid for.
C.9 Late arrival
Your vehicle will be held two (2) hours after the time indicated on your reservation.
If you arrive two (2) hours after the time indicated on your reservation, you must contact the rental agency through which you reserved your vehicle. The agency will do their best to provide you with a vehicle, but availability cannot be guaranteed.
C.10 Early or Late Check-Out
No refund will be made if you return the vehicle before the date and time indicated on your rental agreement.
If you return the vehicle after the date and time indicated on your rental contract, we will charge a late fee equivalent to the additional days consumed. Please note that these additional charges will be billed at the rate in effect at the time the delay is incurred.
By booking on Kirrk.com, we consider the acceptance of the above conditions.
D. Creating the account
D.1 General information
To benefit from the services offered, you must (i) be of legal age; have booked with one of our partner rental agencies (ii); have a reservation compatible with the Kirrk service (iii).
You must start the registration from the link sent by email, then complete the registration form via the Kirrk Application by filling in the information completely and accurately. KIRRK makes its Kirrk Account available to the Customer by assigning a customer ID consisting of the Client's email address and a password defined by the Client.
In order to receive booking confirmations and rental information messages, you will need to provide us with a valid email address and mobile phone number. A code will be sent to you by SMS and requested during your registration.
The Client is required to provide complete and accurate information concerning him/her, including his/her first name and email address, and any other data required for the creation and use of his/her Kirrk Account if applicable. Kirrk reserves the right to refuse to open a Kirrk Account to any Client for legitimate reasons, in particular if there are legitimate reasons to believe that the Client has not complied or will not comply with these general terms and conditions of use.
D.2 Mandatory documents
During your registration, you will be asked to send us, via the Kirrk Application, the following supporting documents:
- A copy of your driver's license. You must keep your driving licence valid in the European Union for the duration of your membership.
- A copy of both sides of a valid identity document (e.g., identity card, passport)
- A picture of you will also be requested, you can take a picture of yourself directly from your mobile phone (we will ask you for prior access to the camera on your phone)
- Your credit card information (prepaid cards as well as instant debit cards such as Visa Electron are not accepted). The cardholder must match the name on the Client's driver's licence. If you do not use a card in your name, we reserve the right to cancel your registration in Kirrk. Credit card registration and payment transactions are directly managed and secured by the payment service provider Stripe.
These help us to verify your identity, ensure Kirrk's security, fight fraud, etc. We'll compare a picture of you to the one on your papers. Your ID will never be shared with a third party. Once your documents are saved in the application, the validation process can take up to 48 hours.
All supporting documents provided by you must be valid at the time of each vehicle rental and for the entire duration of the rental. All these elements must be personal to you and show your identity as indicated when you create your Client account.
D.3 Validation
The validation of your membership will only be effective after verification of your identity via the Kirrk Application. If you do not take part in this identity verification and/or if Kirrk is unable to verify your identity, your membership will be suspended and validated only after validation of your identity by any other means proposed by Kirrk.
By subscribing to the service offered by Kirrk, you acknowledge that you have read the General Terms and Conditions and agree to be bound by them. Each new vehicle rental will result in a reiteration of your acceptance of the terms of the General Terms and Conditions.
D.4 Use of the Kirrk account
The Client undertakes not to disclose to any third party the login credentials to his Kirrk Account (Kirrk ID and Kirrk Password) and not to allow any third party to access Kirrk with these login credentials or otherwise use these login credentials. The Customer is responsible for any use of Kirrk through its login credentials and any other use of its login credentials.
The Client is constantly required to update the information concerning him that he has indicated in his Kirrk Account.
KIRRK may delete the Client's Kirrk Account for the subsequent use of Kirrk at any time and immediately in the event of the Client's failure to comply with any of its contractual obligations under these general terms and conditions of use, without compensation for the Client, without legal formalities and without prior notice, by email sent to the Client at the email address indicated in its Kirrk Account.
The deletion of the Kirrk Account by the Client or KIRRK SAS entails the termination of these general terms and conditions of use.
D.5 Warranty
Before the start of the rental period, Kirrk asks you to register a valid credit card in order to guarantee the rental and the vehicle assigned by the partner rental agency throughout the trip. This is used as a guarantee to pay any additional costs and fees applied by the partner rental agency during your rental. Kirrk acts only as an intermediary between the customer and the partner rental agency. It is therefore necessary that your credit card is valid at least until the scheduled rental end date and has sufficient available funds.
By providing your credit card information, you authorize the partner rental agency via the Kirrk application to :
- The registration of this information with our payment service provider in encrypted format;
- The attachment of this credit card to your Kirrk account
- If necessary, request authorization from the bank to verify the proper availability of funds
- Debit automatically any overruns, additional costs and additional expenses resulting from the use of the vehicle assigned as part of the reservation, including in particular: the costs of initial repair (at the beginning) of the fuel, the costs of repair following damage (or, where applicable, the invoicing of the excess), any cleaning costs.
Credit card registration and payment transactions are directly managed and secured by the payment service provider Stripe.
D.6 Young driver
For any Client under twenty-five (25) years of age, a mandatory surcharge of an amount defined by the chosen rental agency will automatically be applied. If this supplement is not paid, the corresponding reservation may be cancelled.
E. Provision of the vehicle
The vehicle is made available via our partner rental agencies within their car parks or any other nearby location defined by our partner rental agencies.
For all practical purposes, it is reminded that you are responsible for the vehicle from the time it is made available by Kirrk until the end of the journey.
F. Recovery of vehicle keys thanks to the Kirrk application
F.1 Opening the vehicle
The opening of the previously reserved vehicle is carried out by retrieving the keys placed in the vehicle.
To retrieve them, it is therefore essential that the Kirrk Client's account has been validated in advance and that a smartphone in working order and compatible with the Kirrk application, with an Internet connection and Bluetooth functionality, is available to open the trunk of a Kirrk vehicle.
After clicking on "start my rental" on the Kirrk application, you only have to follow the few steps of verification to open the trunk. You can then retrieve the positioned vehicle keys and use them throughout the rental period.
F.2 Inventory of the situation
Before you can retrieve the vehicle keys, you must first perform an inventory of the vehicle.
If the vehicle has damage that is not already listed in the Kirrk Application, you must report this damage by taking a picture of the damaged or missing part of the vehicle. Otherwise, you will be held liable for these damages and any corresponding costs will be invoiced to you. The photos thus taken are stored in the Kirrk Application and will be used, at the end of the rental period, to determine the damage that occurred while the vehicle was in your custody, i.e. from the time Kirrk made it available.
If you notice that the vehicle has blocking damage that has not been listed, please contact the agency through which you booked your vehicle directly.
F.3 Contract
Before you can unlock the vehicle, we ask you to accept the rental agreement displayed in Kirrk's application that summarizes the essential information of your trip and to certify that your driver's license is still valid at the time of pick-up. By accepting this contract, you also confirm that you accept the general rental conditions of the partner rental agency through which you have booked your vehicle.
In case of non-acceptance of the contract, you will not be able to retrieve the keys of the vehicle.
F.4 Safety rules
Under no circumstances should you lend your smartphone or let someone else use your account to drive a Kirrk vehicle. Any use made through your account on the Kirrk Application will be deemed to have been made by you.
In the event of loss or theft of your smartphone that could result in unauthorized use of your account on the Kirrk Application, you must contact the rental agency through which you reserved your vehicle.
G. Conditions of use during the rental period
G.1 Use of the vehicle
By using the vehicle, you confirm that you still hold a valid driver's license and meet the terms and conditions of use of Kirrk, as well as partner rental agencies.
Once you have recovered the keys to your vehicle, use them throughout your rental period as a conventional vehicle.
You will find below some general and non-exhaustive reminders on the use of your vehicle and which are subject to the specific general conditions of use of the agency through which you have made your reservation:
- Any use of the vehicle and any damage to the vehicle shall be deemed to have been made by the Customer who made the reservation, including when the vehicle is used by a third party (i. e. a person other than an additional driver).
- You are responsible for any traffic violations (including parking restrictions, bus lane traffic, speeding, hoof charges, city tolls) and any other costs incurred while using the vehicle.
- You must not smoke or let anyone smoke in the vehicle.
- If the vehicle is damaged, you are responsible for it and you must notify us immediately in the event of an incident.
- If the vehicle breaks down or has an anomaly, let us know immediately. Do not use an independent breakdown service or allow anyone to work on or repair the vehicle without the permission of the partner rental agency.
- If the vehicle is stolen or vandalized, it is imperative that you (i) report it to the police within a maximum of forty-eight (48) hours; and (ii) immediately notify the agency you have been through to book your rental.
- You must not add any equipment or accessories to the vehicle (roof bar, roof rack, ball for towing a trailer/caravan etc.).
- You may only use the vehicle to carry passengers who do not exceed the authorized seating capacity.
- You must not use the vehicle if you are under the influence of alcohol or any other prohibited substance and/or likely to affect your judgment, decrease your reflexes and driving abilities and/or cause drowsiness.
- The use of the vehicle is prohibited for the following purposes: to participate in motor races, rallies, tests or any other competition; for any sublease; for driving instruction; for any illegal purpose; to tow any trailer or vehicle; for the transport of objects or substances that are flammable, corrosive, toxic, explosive, ionizing or bulky and that could damage the vehicle.
G.2 Using the application
The Kirrk application is only used for the recovery of the vehicle and its return to the agency. However, you will be able to follow some additional information about the car (car model, type and level of remaining fuel, mileage covered, maximum mileage reviewed by the rental, vehicle position if geolocation accepted).
H. Return of the vehicle and end of rental
You must return the vehicle at the agreed time. The vehicle must be returned to the agency through which you made your reservation (at opening hours).
You must return the vehicle clean in the same condition as the one in which you received it. Also make sure that the fuel tank is at least at the same level as the departure level of your reservation.
If you cannot bring your vehicle back during the agency's opening hours, leave your vehicle in the agency's parking lot following the procedure to lock it properly.
H.1 End my rental

H.3 Defaults
You are subject to the specific terms and conditions of use of the agency through which you made your reservation.
In the event that the vehicle is dropped off at a different location at the return location initially indicated in the Customer's reservation, a penalty will be applied by the partner rental location via the Kirrk application.
In the event of a delay in the return of the vehicle, a penalty based on the total rental rate will be applied from one (1) hour of delay by the partner rental agency via the Kirrk application.
If the vehicle is not returned by the date indicated in the rental contract, and if Kirrk or the partner agency has not been contacted, Kirrk or the partner agency reserves the right to take legal action against the Customer at fault (filing of a complaint).
I. Financial Conditions
I.1 Booking a rental
The Rental Agreement between the Client and a partner agency governs the price and payment terms of the price to be paid by the Client for the rental service provided by the agency.
You are subject to the specific terms and conditions of use of the agency through which you made your reservation. Financial charges mentioned in the general conditions of use of the latter may be requested by the partner agency if the conditions of use are not respected.
The Client's contact person for a rental service and its payment is the relevant partner agency, which is the Client's sole contractual partner in this respect. The Customer may request reimbursement of a payment only from the relevant contact person.
I.2 Kirrk Service
The use of a Kirrk Account is free of charge for the Client. The costs of connecting to Kirrk and communicating with Kirrk are the exclusive responsibility of the Customer.
Kirrk service is potentially included or as a paid option of the reservation made on the platform of the partner rental agency, depending on the specificities of each partner rental agency. You can find this information in the travel tab of the Kirrk application.
I3. Additional costs
In the event of damage to the vehicle, the partner rental agency may in particular invoice you via the Kirrk application:
- the costs of repairs as well as any costs of managing the damage when the sum of these amounts is less than the amount of the deductible.
- the amount of the deductible when the costs of repairs and any damage management costs are higher than this deductible.
- the costs of repairs as well as any damage management costs when you do not benefit from the insurance provided for in the General Conditions of the partner rental agency.
Costs related to incidents (excluding repairs/damage management) and missing vehicle components reported during receipt of the vehicle may be charged to you outside the application of the deductible.
You will find in Annex (A) of our conditions an indicative table summarizing the pricing elements applied by the partner rental agencies, whose prices may vary according to the origin of the reservation, the rate applied and the category of the vehicle assigned to the rental.
In the event of damage caused to the car and declared by the Customer at the time of the inventory of fixtures at the end of the rental period, an operator of the partner rental agency will assess whether these damages are chargeable. If the damage declared is validated by the latter, the partner rental agency will invoice you through Kirrk for an amount which will be communicated to you by email at the end of the vehicle reception and automatically deducted from the credit card provided when creating the Kirrk account.
If an operator notices damage to the car that has not been reported at the end of the rental period, the partner rental agency will invoice you through Kirrk for an amount that will be communicated to you by email at the end of the vehicle reception and automatically deducted from the credit card provided when the Kirrk account was created.
If the vehicle is not left with at least as much fuel as at the beginning of the rental period, you will be charged for the difference and the corresponding penalty. The price per litre of fuel will be communicated to you via email at the end of the reception.
If the vehicle is returned in a poor state of cleanliness, you will be charged a flat-rate amount for cleaning the vehicle.
I4. Invoicing
By using Kirrk, you agree to pay the partner rental agency via the Kirrk application all rental-related costs (including any additional costs) before your departure if your rental has not been prepaid and to bear all costs related to your use of the vehicle (e.g. fuel, tolls).
At each end of the rental period, we will debit the card registered in your account with the applicable surcharges if observed by the operator receiving the vehicle assigned as part of the reservation.
We will not be responsible for any surcharges, fees or additional costs that your bank may charge you.
In the event of refusal of payment authorization or payment of the rental amount by your bank, we reserve the right to suspend your account and immediately cancel any vehicle reservation you may have made.
By using Kirrk as part of the rental and providing us with your credit card information, you authorize Kirrk and the partner rental agency with which you have booked your vehicle to charge all elements related to your rental, including the insurance deductible in the event of a claim.
J. Insurance and options available
The insurance and options offered are offered to you by the partner rental agency with which the reservation has been concluded. The Kirrk application acts as an intermediary to offer you these options at the conditions and rates applied by the agency.
K. Termination and suspension of your account
If you wish to terminate your membership in Kirrk, you can do so at any time. We will then terminate your membership and close your account. It will no longer be possible for you to make other vehicle reservations.
We may also suspend your membership if your driver's licence no longer meets the conditions required for the use of our vehicles (e.g., cancellation, suspension).
In the event of non-compliance with the General Terms and Conditions, communication of fraudulent documents and/or payment incidents, Kirrk or the partner agency reserves the right to refuse you access to its services, including in the event of the creation of a new Client account.
L. Protection of personal data
The processing of the Client's personal data by KIRRK is governed by Kirrk's privacy policy. By using Kirrk and creating a Kirrk Account, you consent to the processing of your personal data by KIRRK in accordance with the law and the provisions of the Privacy Policy.
The processing of the Client's personal data by the Suppliers is governed by the contractual conditions of the Suppliers.

M. Limitation of liability
In accordance with applicable law, KIRRK may exonerate itself from all or part of its liability by proving that the non-performance or improper performance of these general terms and conditions of use is attributable either to the Client, or to the unforeseeable and insurmountable fact of a third party outside the provision of the services provided for in these general terms and conditions of use such as a Service Provider, or to a case of force majeure.
KIRRK is in no way liable to the Client for the proper performance of obligations resulting from rental contracts or any other contracts concluded with third parties under these general conditions of use such as partner agencies, nor for information, estimates and services provided by third parties such as partner agencies.
N. Modification of the general conditions
KIRRK reserves the right to modify and update these terms and conditions at any time and without notice, in particular if new features, new services or new partnerships are added to KIRRK's offers.
The new version will then be published on our Website and application. The modifications made are binding on you and you are therefore required to refer to them at each connection in order to be aware of the provisions in force with which you must comply. Notification of these changes constitutes acceptance of the terms and conditions, unless you indicate otherwise through our help center.
By making a reservation, you acknowledge that you have read and accepted the rates in effect and the General Conditions applicable by the partner rental agency at that time.
Annex - Extracharge and damage table
As an indication, you will find below a table summarizing the additional costs and the scale of repairs that may potentially be requested by the partner rental agency with which you have booked your vehicle.
This rate is applied when you book directly on the www.kirrk.com website.
These additional charges may vary depending on the partner rental agency, the rate of the reservation and the vehicle category assigned to you.
These fees are updated regularly by the partner rental agencies and a variance of plus or minus 20% of the indicated price can be observed depending on the updates.
